NASA sun close-ups, 'never-before-seen'

Using a relatively small telescope, NASA scientists were able to capture images of an active region of the sun. Other telescopes focus on larger swaths of the sun, while this one zoomed in on 'real fine structure'.?

Designed to observe the hottest part of the sun ? its corona ? the small High-Resolution Coronal Imager (Hi-C) launched on a suborbital rocket that fell back to Earth without circling the planet even once. The experiment revealed never-before-seen "magnetic braids" of plasma roiling in the sun's outer layers, NASA announced today (Jan. 23)

"300 seconds of data may not seem like a lot to some, but it's actually a fair amount of data, in particular for an active region" of the sun, Jonathan Cirtain,?Hi-C mission?principal investigator at NASA's Marshall Space Flight Center in Huntsville, Ala., said during a NASA press conference today.

The solar telescope snapped a total of 165 photos during its mission, which lasted 10 minutes from launch to its parachute landing.

Hi-C launched from White Sands Missile Range in New Mexico?atop a sounding rocket in July 2012. The mission cost a total of $5 million ? a relative bargain for a NASA space mission, scientists said. The experiment was part of NASA's Sounding Rocket Program, which launches about 20 unmanned suborbital research projects every year. [NASA's Hi-C Photos: Best View Ever of Sun's Corona]

"This mission exemplifies the three pillars of the [sounding rocket] program: world-class science, a breakthrough technology demonstration, and the training of the next generation of space scientists," said Jeff Newmark, a Sounding Rocket Program scientist at NASA Headquarters in Washington, D.C.

Hi-C?used a modified Cassegrain telescope with a 9.5-inch-diameter mirror to take close-up images of an active region on the sun, achieving a resolution equivalent to sighting a dime from 10 miles away.

While NASA already has telescopes in orbit constantly monitoring the whole?surface of the sun, such as the Solar Dynamics Observatory (SDO), the Hi-C mission allowed scientists to focus in on a smaller region than SDO is able to.

"SDO has a global view of the sun," Newmark said. "What this research does is act like a microscope and it zooms in on the real fine structure that's never been seen before."

The next step, the researchers said, is to design a follow-up instrument to take advantage of the new telescope technology tested out by Hi-C, to observe for a longer period of time on an orbital mission.

"Now we've proven it exists, so now we can go study it," said Karel Schrijver, a senior fellow at the Lockheed Martin Advanced Technology Center in Palo Alto, Calif., where the instrument was built.?

Antarctic lake beneath the ice sheet tested

Jan. 29, 2013 ? In a first-of-its-kind feat of science and engineering, a National Science Foundation (NSF)-funded research team has successfully drilled through 800 meters (2,600 feet) of Antarctic ice to reach a subglacial lake and retrieve water and sediment samples that have been isolated from direct contact with the atmosphere for many thousands of years.

Scientists and drillers with the interdisciplinary Whillans Ice Stream Subglacial Access Research Drilling project (WISSARD) announced Jan. 28 local time (U.S. stations in Antarctica keep New Zealand time) that they had used a customized clean hot-water drill to directly obtain samples from the waters and sediments of subglacial Lake Whillans.

The samples may contain microscopic life that has evolved uniquely to survive in conditions of extreme cold and lack of light and nutrients. Studying the samples may help scientists understand not only how life can survive in other extreme ecosystems on Earth, but also on other icy worlds in our solar system.

The WISSARD teams' accomplishment, the researchers said, "hails a new era in polar science, opening a window for future interdisciplinary science in one of Earth's last unexplored frontiers."

A massive ice sheet, almost two miles thick in places, covers more than 95 percent of the Antarctic continent. Only in recent decades have airborne and satellite radar and other mapping technologies revealed that a vast, subglacial system of rivers and lakes exists under the ice sheet. Lakes vary in size, with the largest being Vostok Subglacial Lake in the Antarctic interior that is comparable in size to Lake Ontario.

WISSARD targeted a smaller lake (1.2 square miles in area), where several lakes appear linked to each other and may drain to the ocean, as the first project to obtain clean, intact samples of water and sediments from a subglacial lake.

The achievement is the culmination of more than a decade of international and national planning and 3 1/2 years of project preparation by the WISSARD consortium of U.S. universities and two international contributors. There are 13 WISSARD principal investigators representing eight different U.S. institutions.

NSF, which manages the United States Antarctic Program, provided over $10 million in grants as part of NSF's International Polar Year portfolio to support the WISSARD science and development of related technologies.

The National Aeronautics and Space Administration's (NASA) Cryospheric Sciences Program, the National Oceanic and Atmospheric Administration (NOAA), and the private Gordon and Betty Moore Foundation also provided support for the project.

The interdisciplinary research team includes groups of experts in the following areas of science: life in icy environments, led by John Priscu, of Montana State University; glacial geology, led by Ross Powell, of Northern Illinois University; and glacial hydrology, led by Slawek Tulaczyk, of the University of California, Santa Cruz.

Sharing of expertise by the groups of disciplinary experts will allow the data collected to be cast in a systemic, global context.

The WISSARD team will now process the water and sediment samples they have collected in hopes of answering seminal questions related to the structure and function of subglacial microbial life, climate history and contemporary ice-sheet dynamics.

Video surveys of the lake floor and measurements of selected physical and chemical properties of the waters and sediments will allow the team to further characterize the lake and its environs.

The approach to drilling was guided by recommendations in the 2007 National Research Council-sponsored report, "Exploration of Antarctic Subglacial Aquatic Environments: Environmental and Scientific Stewardship," aimed to protect these unique environments from contamination.

A team of engineers and technicians directed by Frank Rack, of the University of Nebraska-Lincoln, designed, developed and fabricated the specialized hot-water drill that was fitted with a filtration and germicidal UV system to prevent contamination of the subglacial environment and to recover clean samples for microbial analyses. In addition, the numerous customized scientific samplers and instruments used for this project were also carefully cleaned before being lowered into the borehole through the ice and into the lake.

Following their successful retrieval, the samples are now being carefully prepared for their shipment off the ice and back to laboratories for numerous chemical and biological analyses over the coming weeks and months.

For Diabetes: BP, Cholesterol Key v. Heart Disease

Jan. 28, 2013 -- People with diabetes who want to lower their risk of heart attack and stroke should focus on controlling their blood pressure and ''bad'' cholesterol, according to a new study of more than 26,000 patients.

Controlling both these risk factors, the researchers found, made patients less likely to be hospitalized for heart attacks or strokes than those who only controlled blood sugar during the six-year follow-up.

"It's not that blood glucose is not important. It's that low-density cholesterol and blood pressure control are more important if cardiovascular disease is what you are trying to prevent," says Gregory A. Nichols, PhD, a senior investigator at Kaiser Permanente Center for Health Research.

The study is published in the Journal of General Internal Medicine.

Diabetes & Heart Disease: Study Details

More than 18 million people in the U.S. have diabetes, according to the American Diabetes Association.?

Those with type 2 diabetes (in which the body doesn't make enough insulin or use it properly) have a higher risk of heart disease and stroke.

To minimize the risk, research suggests, those with diabetes should control not only blood sugar levels but also their LDL or ''bad" cholesterol and their blood pressure.

However, Nichols says, he is not aware of any study that looked at the contribution of these risk factors to heart attack or stroke risk among people with diabetes.

For the new study, the researchers calculated all patients' average values on systolic blood pressure (the upper number of the reading), cholesterol, and blood sugar levels.

"There were actually eight different possible categories," Nichols says. These ranged from having none of the risk factors under control to having all of them under control.

Guidelines suggest that systolic blood pressure in those with type 2 diabetes should be less than 130.

"LDL ideally is less than 100 [mg/dL] and A1c [a blood sugar measure] is less than 7%," Nichols says.

Next, they looked at whether the patients had a hospital admission with a diagnosis of heart disease or stroke. During the study, 1,943 patients were hospitalized for those reasons.

Those who were in the hospital were on average 65 years old. Those who were not were on average 58.

Nichols looked at the risk factor status of all patients.

(AP) ? The British government on Monday unveiled details of new high-speed rail lines linking London to cities in northern England with trains traveling up to 225 miles an hour (360 kph).

The government says the project, known as High Speed 2, will be the first new railway built north of London for more than a century, and will be an economic and environmental boon. But opponents claim the plan is too expensive and will ruin tracts of picturesque countryside.

The first 140-mile (225-kilometer) stretch of the line, announced last year, will link London to Birmingham, England's second-largest city. The Y-shaped section announced Monday will extend to the northern cities of Manchester and Leeds.

Construction of the first section of the line is due to start in 2017 and be completed by 2026. The second phase is to be done by 2032.

Officials say the 32.7 billion-pound ($51 billion) project will create at least 100,000 jobs and cut journey times almost in half, covering the 200 miles (320 kilometers) between London and Manchester in an hour and eight minutes.

Treasury chief George Osborne said the railway would be "the engine for growth in the north and the Midlands of this country" ? and worth it, despite the opposition.

"If our predecessors hadn't decided to build the railways in the Victorian times or the motorways in the middle part of the 20th century, then we wouldn't have those things today," Osborne told the BBC.

"So you've got to commit to these projects, even though they take many years and, yes, they are expensive, but they are also an investment in the economy that will then create the money to enable us to afford our NHS (health service) and our education system and so on," he said.

High Speed 1, which linked London to the tunnel under the English Channel, was completed in 2007.

Be Lifehacker's New Weekend Contributing Editor

Be Lifehacker's New Weekend Contributing EditorWant to write for Lifehacker? We're on the hunt for a new contributing editor to manage our Saturday and Sunday tips and tricks. Interested? Here's what you need to know.

The weekend contributing editor should be able to work a full day on Saturday and Sunday, and should be self-sufficient, because you're going to be working by yourself a lot of the time. Also, these are important qualities to have:

  • The ability to check into email and chat on the weekdays. Although we're not going to be asking you to write on the weekdays or be available all day, we will often assign you items, send you notes, and want to communicate a bit during the week.
  • An excellent understanding of Lifehacker. You should be a reader, at least, but also know exactly what it is that makes us tick. It's kind of an intangible quality, knowing what kind of posts we write (and which ones we don't), but it's a vital one.
  • Prior writing experience. You don't need to have years and years of experience, but the experience of having written professionally is a big plus.
  • The ability to write quickly and coherently.
  • Willingness to take direction.

Being a weekend Lifehacker contributor editor is actually a pretty decent start to being a full-time and salaried weekday Lifehacker writer. We've hired weekend people in the past, so keep that in mind as you're applying. And, even if you don't get the weekend job, applying can still give you the opportunity to fill in for writers when they go on vacation, or other small freelance opportunities at the site.

  • Send all email applications to wannabeweekend@lifehacker.com with the subject Lifehacker Weekend Contributing Editor.
  • Include prior writing experience and links to them.
  • In the email, a few sentences about yourself. Good things to discuss are why you want to be a weekend writer, your interests and experience that fit with Lifehacker (programming/writing/hacking/DIY experience), and your availability (when you can start). Focus on the fact that being concise is much more effective, but write as much as you need to to tell us what experience you have and what special circumstances allow you to be a great Lifehacker weekend writer.
  • No attachments

We get a lot of emails, so unfortunately we can't reply to everyone. If we do contact you, it may not be immediately so please be patient. If you don't hear from us, feel free to give it another shot in the future.

What?s next for Anthony Pettis? Waiting patiently for the lightweight title shot

With his performance against Donald Cerrone on Saturday night, Anthony Pettis made a believer out of many fight fans. One of those who now thinks Pettis belongs in the title shot conversation is UFC president Dana White.

While the next bout for UFC lightweight champion Benson Henderson is set with Strikeforce champion Gilbert Melendez in April, Pettis has set himself up as the obvious next man up.

"I think the Melendez fight is pretty set, but (Pettis is) next. I can't say enough things about the kid tonight. That was incredible," White said in the postfight press conference.

The last time Pettis had a title shot, he had a wrench thrown into the plans. Pettis won the WEC lightweight belt in the promotion's final fight. A title shot was promised to whoever had the belt when the WEC merged with the UFC.

But two weeks after Pettis won the belt, Frankie Edgar and Gray Maynard faced off for the belt. They fought to a draw and Edgar kept the belt, but Maynard was given an immediate rematch.

Instead of waiting for the title shot then, Pettis fought Clay Guida. He lost a decision, and the title shot was gone. This time, he's not going to let the title shot slip through his hands.

"If it's a guaranteed title shot, then I'm waiting. That was my goal this year, and I'm definitely going to wait and get better," Pettis said.

The way title shots have been going in the UFC, there's no way to know if Pettis is making the right call. However, what Pettis is doing is setting himself up as the go-to guy if the UFC needs him. Melendez has had to postpone fights because of injuries in the past, and you never know what could happen as fighters prepare for their bouts.

Three residents were displaced and a home was heavily damaged after a blaze broke out around 2 p.m. Friday on the 300 block of Washington Avenue in North Wales.

?The neighbors heard something popping, and ran out and saw the side of the house on fire. We don?t know, we?re still investigating if that popping was the cause or one of the effects of the fire,? said Chris Park, Chief of the North Penn Fire Company.

That company and several others battled the fire for roughly an hour before bringing it under control, but not before much of the home?s second floor and first-floor roof were charred by the fire.

The cause is still under investigation, but PECO crews were on scene and cut utility lines to the house as firefighters took turns entering the house and dousing flames visible on the wooden eaves of the house.

Park said all three residents were unhurt and staying with friends and family, but declined to identify the victims further. No information was available Friday afternoon about any pets that may have lived in the house.

Montgomery County property records identify the property owners as Lambert and Claire Liebel, and family members at the scene said Claire, her son and daughter-in-law were inside and escaped the fire.

?There?s heavy exterior damage from fire, smoke and the water. We?re going to be out here for at least several more hours, just making sure everything?s completely out,? Park said.

Volunteer Medical Service Corps of Lansdale deployed an inflatable heated tent at the scene for emergency responders to stay warm, and Park said as of 4 p.m. Friday, firefighters were using it to warm up but none had been hurt while fighting the fire.

Jayne Blackledge, Director of the nearby North Wales Area Library, said that facility had its doors open for victims and emergency responders to come inside and warm up, and several had done so as snow fell on the fire scene.

?We have a microwave, we have restrooms, it?s a good place to come in and warm up. That?s what libraries are for,? she said.

The Ravens had a light practice Saturday, their last of the season before heading to the Big Easy. The team is off Sunday and will head south Monday in anticipation of their matchup on Feb. 3 with the San Francisco 49ers.

After Saturday's session, coach John Harbaugh said, "We've had a great week. We had an excellent practice. The guys are very sharp and they're excited. We'll have to go down there and do just as well and do better."

Harbaugh called the 49ers "a very well-coached football team." He said it with a grin, because San Francisco is coached by his little brother, Jim.

Court says Obama appointments violate constitution

(AP) ? President Barack Obama violated the Constitution when he bypassed the Senate last year to appoint three members of the National Labor Relations Board, a federal appeals court ruled Friday in a far-reaching decision that could severely limit a chief executive's powers to make recess appointments.

The decision of the U.S. Court of Appeals for the D.C. Circuit marked a victory for Republicans and business groups critical of the labor board. If it stands, it could invalidate hundreds of board decisions over the past year, including some that make it easier for unions to organize.

When Obama filled the vacancies on Jan. 4, 2012, Congress was on an extended holiday break. But GOP lawmakers gaveled in for a few minutes every three days just to prevent Obama from making recess appointments. The White House argued that the pro forma sessions ? some lasting less than a minute ? were a sham.

The court rejected that argument, but went even further, finding that under the Constitution, a recess occurs only during the breaks between formal year-long sessions of Congress, not just any informal break when lawmakers leave town. It also held that presidents can bypass the Senate only when administration vacancies occur during a recess.

White House press secretary Jay Carney said the administration strongly disagrees with the decision and that the labor board would continue to conduct business as usual, despite calls by some Republicans for the board members to resign.

"The decision is novel and unprecedented," Carney said. "It contradicts 150 years of practice by Democratic and Republican administrations."

Under the court's decision, 285 recess appointments made by presidents between 1867 and 2004 would be invalid.

The Justice Department hinted that the administration would ask the Supreme Court to overturn the decision, which was rendered by three conservative judges appointed by Republican presidents. "We disagree with the court's ruling and believe that the president's recess appointments are constitutionally sound," the statement said.

The court acknowledged that the ruling conflicts with what some other federal appeals courts have held about when recess appointments are valid, which only added to the likelihood of an appeal to the high court.

"I think this is a very important decision about the separation of powers," said Carl Tobias, a constitutional law professor at Virginia's University of Richmond. "The court's reading has limited the president's ability to counter the obstruction of appointments by a minority in the Senate that has been pretty egregious in the Obama administration."

The ruling also threw into question the legitimacy of Obama's recess appointment of Richard Cordray to head the Consumer Financial Protection Bureau. Cordray's appointment, made on the same date, has been challenged in a separate case.

Carney insisted the court's ruling affects only a single case before the labor board and would have no bearing on Cordray's appointment. Obama on Thursday renominated Cordray for the job.

The case challenging the recess appointments was brought by Noel Canning, a Washington state bottling company that claimed an NLRB decision against it was not valid because the board members were not properly appointed. The D.C. Circuit panel agreed.

Obama made the recess appointments after Senate Republicans blocked his choices for an agency they contended was biased in favor of unions. Obama claims he acted properly because the Senate was away for the holidays on a 20-day recess. The Constitution allows for such appointments without Senate approval when Congress is in recess.

But during that time, GOP lawmakers argued, the Senate technically had stayed in session because it was gaveled in and out every few days for so-called pro forma sessions.

GOP lawmakers used the tactic ? as Democrats had done in the past ? specifically to prevent the president from using his recess power to install members to the labor board and the consumer board. They had also vigorously opposed the nomination of Cordray.

The three-judge panel flatly rejected arguments from the Justice Department's Office of Legal Counsel, which claimed that the president has discretion to decide that the Senate is unavailable to perform its advice and consent function.

"Allowing the president to define the scope of his own appointment power would eviscerate the Constitution's separation of powers," Chief Judge David Sentelle wrote in the 46-page ruling. He was appointed by President Ronald Reagan.

The court ruled that during one of those pro forma sessions on Jan. 3, 2012, the Senate officially convened its second session of the 112th Congress, as required by the Constitution.

Sentelle's opinion was joined by Judge Thomas Griffith, appointed to the court by President George W. Bush, and Karen LeCraft Henderson, who was appointed by President George H.W. Bush.

"With this ruling, the D.C. Circuit has soundly rejected the Obama administration's flimsy interpretation of the law, and (it) will go a long way toward restoring the constitutional separation of powers," said Sen. Orrin Hatch, R-Utah.

GOP House Speaker John Boehner welcomed the ruling as "a victory for accountability in government."

If the ruling stands, it would invalidate more than 600 board decisions issued over the past year. It also would leave the five-member labor board with just one validly appointed member, effectively shutting it down. The board is allowed to issue decisions only when it has at least three sitting members.

Obama used the recess appointment to install Deputy Labor Secretary Sharon Block, union lawyer Richard Griffin and NLRB counsel Terence Flynn to fill vacancies on the labor board, giving it a full contingent for the first time in more than a year. Block and Griffin are Democrats, while Flynn is a Republican. Flynn stepped down from the board last year.

All three vacancies on the labor board had been open for months before Obama acted to fill them.

Sen. Tom Harkin, D-Iowa called the ruling "a radical departure from precedent" and argued that Obama had no choice but to act.

"Throughout his presidency, Republicans have employed unprecedented partisan delay tactics and filibusters to prevent confirmation of nominees to lead the NLRB, thus crippling the board's legal authority to act," Harkin said.

If Obama's recess appointment of Cordray to the newly created consumer board is eventually ruled invalid, it could nullify all the regulations the consumer board has issued, many of which affect the mortgage business.

It is rewarding to receive pictures of an area that I helped to furnish,? said Tammy when asked what she liked most about being a ParknPool account manager. ?Working with Tammy on all of our outdoor projects has been a joy! She?s very customer service oriented and goes above and beyond to make my job (and hers) as easy as possible,? stated Fox River Resort in response to a client survey.

As an Army veteran of Iraq and Afghanistan, Chris Lopez, has been an account manager at ParknPool for the better part of a year. ?Chris answered all my questions and was very helpful in the entire process. I look forward to doing business with him and your company again,? complimented RPI Design Goods. Chris enjoys applying the variety of skills he learned while being in the armed forces to help his clients. ?After coming to ParknPool by way of the military, it is definitely a much more relaxed environment to work in. All of my clients are great to deal with,? explained Chris. As one of ParknPool?s leading account managers, Sarah Dudley is originally from Lexington, VA and though she moved away for a brief time, is now back in the area. When asked what she enjoys about her job, she excitedly remarked, ?It?s important, at the end of the day, that you take pride in what you do on a daily basis. It?s not every day that I get to truly make a difference but when the occasion arises, it makes it all worthwhile. After helping to save a Tennessee high school homecoming with bleachers, Sarah was complimented with this remark by the White House Heritage High School Booster Club, ?Sarah was responsive and cared about our school and community ? we couldn?t have achieved our goal without her!?

Black silicon can take efficiency of solar cells to new levels

Black silicon can take efficiency of solar cells to new levels [ Back to EurekAlert! ] Public release date: 25-Jan-2013

This press release is available in German.

Scientists at Aalto University, Finland, have demonstrated results that show a huge improvement in the light absorption and the surface passivation on highly absorbing silicon nanostructures. This has been achieved by applying atomic layer coating. The results advance the development of devices that require high sensitivity light response such as high efficiency solar cells.

This method provides extremely good surface passivation. Simultaneously, it reduces the reflectance further at all wavelengths. These results are very promising considering the use of black silicon (b-Si) surfaces on solar cells to increase the efficiency to completely new levels, tells Pivikki Repo, a researcher at Aalto University.

More effective surface passivation methods than those used in the past have been needed to make black silicon a viable material for commercial applications. Good surface passivation is crucial in photonic applications such as solar cells. So far, the poor charge carrier transport properties attributed to nanostructured surfaces have been more detrimental for the final device operation than the gain obtained from the reduced reflectance.

Black silicon can also be used in other technologies than solar cells. Numerous applications suggested for b-Si include drug analysis.

Black silicon (b-Si) has been a subject of great interest in various fields including photovoltaics for its ability to reduce the surface reflectance even below 1 per cent. However, many b-Si applications - especially solar cells - suffer from increased surface recombination resulting in poor spectral response. This is particularly problematic at short wavelengths.

J.J. Abrams set to direct next "Star Wars" film

NEW YORK (TheWrap.com) - J.J. Abrams will direct the next "Star Wars" film for Disney, taking stewardship of one of Hollywood's most iconic and lucrative film franchises, an individual with knowledge of the production told TheWrap.

"Argo" director Ben Affleck was also in contention, another individual with knowledge of the talks told TheWrap.

Ever since Disney bought Lucasfilm last year and announced it would make new "Star Wars" films, fans, members of the media and industry executives have speculated about which director would take the job. Abrams' name always came up, but he told Entertainment Weekly in November that he wasn't going to take the job.

He did say "Star Wars" was the first movie that "blew my mind" in terms of special effects.

Lucasfilm Chief Kathleen Kennedy has been courting Abrams, one of the most successful directors and producers in Hollywood - and a man beloved by fanboys. He runs one of the industry's top production companies, Bad Robot, and created or co-created television franchises like "Lost," "Fringe" and "Alias." He has also directed film spectacles "Mission: Impossible III," "Star Trek" and "Super 8."

The lure of the Jedi was too strong, and it will no doubt complicate his relationship with Paramount, where Bad Robot is a top supplier. Abrams has been feverishly working on "Star Trek Into Darkness," his second Star Trek film since he rebooted the franchise in 2009. "Into Darkness," still in post-production, opens May 18.

Though he has several producing jobs in front of him, Abrams had been uncommitted as a director. He will have to jump right into "Star Wars," which Disney has slated for a 2015 release. "Little Miss Sunshine" screenwriter Michael Arndt is penning the script.

Reached by TheWrap, Lynne Hale, spokeswoman for Lucasfilm, declined to comment immediately. Neither CAA, which represents Abrams, nor Bad Robot immediately responded to requests for comment.

International Criminal Law Ferment: Oral Hearings Conclude in ...

Here is the latest press release from the Special Court for Sierra Leone. The Court announces the conclusion of the oral hearings, which have been taking place in The Hague over the past couple of days, in?Prosecutor v. Charles Ghankay Taylor. The Appeals Chamber permitted Taylor to give a short statement at the end of the hearing, something that is not as common a practice in other international criminal tribunals.

They are forecasting that the appeals judgment will be available "before the end of 2013". Closer to the end of the year is simply too far away for a single accused trial. Although I had thought I read somewhere an earlier forecast of September 2013.?Perhaps they realized that September 2013 was too ambitious and want to manage the public's?expectations, which is a great strategy instead of announcing a timeline and failing to meet it (as the Trial Chamber did several times in regards to the trial judgment).

At the same time, the appeals judges and their legal officers?now obviously have their calendars booked over the next eight to ten months as they should closely be reviewing the voluminous 2,300+ page trial?judgment which made a record for its length when it was issued. Yet, it came under serious criticism for 42?alleged legal/factual errors according to the defense and 4 according to the prosecution. Perhaps this is a case where less could have been more?

While it is sometimes unfair for states to impose strict timelines on judges - as tends to happen with completion strategies - it is clear that the Appeals Chamber, now left with effectively one substantive?war crimes case on their docket at the SCSL, will not have any excuse for failing to issue the judgment before the end of the year. That said, many involved in this process will probably not mind if the Appeals Chamber takes its time but in the end issues a solid judgment with solid reasoning addressing all the solid issues by the end of this year.

Whatever it does, the Appeals Chamber should be sure to attend to the substantive allegations made by Trial Chamber II Alternate Judge El Hadj Malick Sow. As is well known by now, Alternate Judge Sow made serious allegations at the end of the hearing on April 26, 2012. More recently, he fleshed out his views?to the New African magazine, all of which raised fundamental concerns about the quality of the deliberations that took place in the Taylor case.

If?the Appeals Chamber addresses that issue, and the others raised by the parties,?given the?near unique issues that came up in that trial,?the Taylor judgment will probably be remembered in the future as?a valuable contribution to international criminal law. It goes without saying that a failure to properly?do so might well tarnish the future legitimacy of that important trial and its?final?outcome.

PRESS RELEASE

The Hague, 23 January 2013

Oral hearings Conclude in Taylor Appeal, Judges Will Now retire to deliberate and Consider Judgement

Lawyers for the Prosecution and??Defence made their final arguments before the Appeals Chamber this week in the trial of former Liberian President Charles Taylor. The five Judges and one Alternate Judge heard Appeal Submissions from the parties on Tuesday, and their Responses and Replies on Wednesday.

On 26 April 2012, the Trial Chamber found Mr. Taylor guilty on all 11 counts of the indictment, finding that he had participated in the planning of crimes, and of aiding and abetting crimes, committed by rebel forces in Sierra Leone. On 30 May 2012, the Trial Chamber sentenced him to a prison term of 50 years.

The Defence has presented 42 grounds of appeal, arguing that the Trial Chamber made systematic errors in the evaluation of evidence and in the application of law sufficiently serious to ?reverse all findings of guilt entered against him? and to vacate the judgement. The Defence brief also questioned the fairness of the trial and the judicial process itself, and challenged the 50 year sentence imposed by the Chamber as being ?manifestly unreasonable.???

The Prosecution has also appealed the judgement on four grounds, arguing that Mr. Taylor should have been found guilty of other modes of liability, and that he should have received a significantly longer sentence.

For the oral arguments, the Appeals Chamber asked both the Prosecution and the Defence to address six questions (set forth in full below), looking at the application of international law to modes of liability, the extent to whether uncorroborated hearsay evidence may be relied upon in determining findings of fact, and how existing jurisprudence relating to adjudicated facts should be applied to a Defence motion to admit adjudicated facts after the Prosecution had closed their case.

Both parties expressed appreciation for the opportunity to address ?these important legal questions?.

At the end of Wednesday?s proceedings, Charles Taylor was allowed to make a statement. ?I?m very appreciative of the handling of the proceedings so far, and I have the belief that the right thing will be done by the grace of Almighty God,? he told the Judges.

This week?s hearing is the last in the Taylor case before the appeal judgement is delivered. It also marks the achievement of an important milestone as the Court nears the completion of its mandate. The Judges will now retire to deliberate and consider their judgement, expected before the end of 2013.

#END

i. Whether the Trial Chamber correctly articulated the actus reus elements of aiding and abetting liability under customary international law. The differences and similarities between aiding and abetting, instigating and ordering as forms of liability under Article 6(1) of the Statute. Whether customary international law recognizes that certain forms of liability set forth in Article 6(1) of the Statute are more or less serious than other forms of liability for sentencing or other purposes.

ii. Whether the Trial Chamber?s findings meet the mens rea standard of purpose.
iii. Whether acts of assistance not ?specifically directed? to the perpetration of a crime can substantially contribute to the commission of a crime for aiding and abetting liability. Whether the Trial Chamber?s findings meet the ?specific direction? standard.
iv. Whether the acts of assistance not to the crime ?as such? can substantially contribute to the commission of the crime for aiding and abetting liability. Whether the Trial Chamber?s findings meet the ?as such? standard.

v. Whether the sources of law identified in Rule 76 bis (ii) and (iii) establish that uncorroborated hearsay cannot be relied upon as the sole basis for specific incriminating findings of fact.

vi. How the Appeals Chamber should apply existing jurisprudence relating to adjudicated facts under Rule 94(B) in the context of a defence motion for the admission of adjudicated facts following the close of the prosecution case.

The Special Court is an independent tribunal established jointly by the United Nations and the Government of Sierra Leone. It is mandated to bring to justice those who bear the greatest responsibility for atrocities committed in Sierra Leone after 30 November 1996.

Five "Good Habits" You Need to Unlearn

Sean Blanda

Five "Good Habits" You Need to UnlearnProductivity is an ever-evolving study of what works and what doesn't. The way we work can change at a rapid-fire pace and what was accepted as a best practice in years past, can now do more harm than good. The team at 99U focuses on the creative insights we didn't get in school which, sometimes, means we have to unlearn habits that were previously perceived as being "good." Below are some tips that go against the grain of typical productivity advice.

Stop Thinking So Positively

When we visualize our goals as already achieved, it can subconsciously lull our minds into complacency. Goals are important, but make sure you are mindful of the difficulties that you will face along the way.

Stop Trying to Fill Every Hour of Your Day

Ever wonder why you get most of your ideas in the shower? It's because the shower is among the last sacred spaces where we aren't distracted by colleagues or technology. Our ideas need time to ferment and connect with other ideas, and being bored allows our minds to accomplish this naturally.

Stop Caring What the Internet Thinks About You

It feels good to check our blog's traffic, Google our names, or compare our Twitter follower counts, but this kind of "insecurity" work rarely helps us advance our creative pursuits. Tasks like these are intellectual empty calories, giving us the appearance of doing work. If you truly want these measurements to rise, focus on getting things done while compartmentalizing these activities to specifics times during your week.

Stop Equating Rejection with Failure

Getting rejected, while painful, isn't what can hold us back? it's how we react to such setbacks that often determines our success. Research shows that handling rejection with an "I'll show them" mentality can actually boost performance over those who have the easier route of acceptance.

Stop Spending More Time on Your Work

When we feel we need to get more stuff done, many of us invest more of our time and work weekends or evenings. The funny thing is, our time is finite and by overworking ourselves we can cause collateral damage to our creativity. Instead of spending more time on our work we should spend less. By embracing our bodies' natural rhythm of "pulsing and pausing" we can sustain our energy levels.

This post is part of a monthly series by 99U that will deliver the action-oriented education that you didn't get in school, highlighting real-world best practices for making your ideas happen.

Sean Blanda is the Associate Editor of 99U, the "think tank" of Behance. You can find him on Twitter at @SeanBlanda.

Good grief! Charlie Brown voice actor arrested

Alberto E. Rodriguez / WireImage file

Voice actor Peter Robbins and Charlie Brown attend the DVD release for "You're Not Elected, Charlie Brown" in Hollywood on Oct. 7, 2008.

By Randee Dawn, TODAY contributor

The onetime voice of Charlie Brown in the animated "Peanuts" TV series was arrested on Sunday on five felony charges, NBC News confirms.

Peter Robbins has been charged with four felony counts of making a threat to cause death or great bodily injury, and a single felony count of stalking. After being booked in San Diego just after 3:30 a.m. local time on Monday, he was held on $550,000 bail. He is scheduled for arraignment on Wednesday.

The San Diego Union-Tribune reported that Robbins was arrested on Sunday evening as he crossed into the United States from Mexico at the San Ysidro Port of Entry. He was alone in his 2006 Mercedes-Benz C230 when a border officer pulled him aside for an examination. During that check, the officers learned he was wanted by the San Diego Sheriff's Department on a felony warrant for crimes against a person, said a U.S. Customs and Border Protection representative.

During an interview at San Diego's Comic-Con, Robbins, 56, said he'd begun as the original voice of Charlie Brown when he was 9 (video below). He voiced several "Peanuts" TV specials and films, including "A Charlie Brown Christmas," "It's the Great Pumpkin, Charlie Brown" and "A Boy Named Charlie Brown." When he reached 14, "it was time to move on," he said in that interview. His acting career also included roles on shows like "My Three Sons" and "F Troop."

Robbins' manager told the Union-Tribune that she was unable to discuss his arrest at the time, but planned to comment later Wednesday.

Nearly 40 percent of House members don?t represent their birth state

Thirty-eight percent of the members of the U.S. House of Representatives represent a state in which they weren't born, according to findings released Tuesday from Smart Politics.

In Alaska, Vermont and Montana?which are each apportioned one House Member-at-Large?the representative was not born in the state. And just 18 percent of the delegation in Virginia (2 out of 11 members) were born in the state; 25 percent were born in Minnesota, and 37.5 percent in Maryland.

One might surmise that today's mobile society has contributed to this statistic, but Smart Politics' Eric Ostermeier writes that "it is the younger U.S. Representatives serving in the 113th Congress who are most likely to represent a district in the state of their birth."

The number of lawmakers representing the state of their birth has actually increased over time.

Smart Politics noticed no difference in rates of representation of birth states when members were divided by party affiliation.
